These General Terms of Use (hereinafter “TOU”) govern the access and use of all content, features, products, and services available on the website Mixowear.com (hereinafter the “Site”), operated by MixoWear (“we”, “our”, “us”).

Accessing and using the Site implies full and complete acceptance of these TOU, without modification or reservation, as well as any other policy or operating rule published by MixoWear.

If you do not accept all or part of these terms, you must immediately stop using the Site and its services.

SITE ACCESS

Access to the Site is free. Certain services, particularly product purchases, require the creation of an account or the provision of accurate personal information.

MixoWear reserves the right to suspend, limit, or interrupt access to the Site, temporarily or permanently, notably for maintenance or in case of non-compliance with these TOU.

INTELLECTUAL PROPERTY

All content present on the Site (text, images, logos, graphics, videos, designs, trademarks, trade names) is protected by intellectual property laws. No intellectual property rights are transferred to the user. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization from MixoWear is strictly prohibited.

THIRD-PARTY SERVICES

The Site may contain links to services, content, or websites operated by third parties (“Third-Party Services”). Use of these Third-Party Services is under the sole responsibility of the user. MixoWear shall not be held responsible for the content, practices, policies, or damages resulting from the use of these external services.

USER ACCOUNTS

When account creation is required:

  • The user agrees to provide accurate, complete, and up-to-date information.
  • The user is solely responsible for the use of their account.
  • Login credentials must remain strictly confidential.

Any fraudulent or unauthorized use of the account must be reported immediately to MixoWear.

TERMINATION

MixoWear reserves the right to suspend or terminate a user’s access to the Site or their account at any time, without notice, in case of violation of these TOU or abusive behavior. The user may terminate their account at any time by ceasing to use the services or by contacting support. Clauses that, by their nature, should survive termination (intellectual property, liability, applicable law) will remain in effect.

LIMITATION OF LIABILITY

The services are provided “as is” and “as available”. MixoWear does not guarantee:

  • The absence of errors or interruptions.
  • Continuous availability of the Site.
  • The suitability of the services for a particular purpose.
  • The use of the Site is at the user’s own risk.

MixoWear shall not be held liable for any direct or indirect damages resulting from the use or inability to use the Site.

APPLICABLE LAW AND JURISDICTION

These TOU are governed by Moroccan law. Any dispute relating to the interpretation or execution of these TOU shall be subject to the exclusive jurisdiction of the Moroccan courts.

MODIFICATIONS TO TERMS

MixoWear reserves the right to modify these TOU at any time. Changes will take effect upon publication on the Site. Continued use of the Site after modification constitutes acceptance of the new terms. It is the user’s responsibility to regularly consult the TOU.
